Acceptance of These Terms

These Terms of Use (“Terms”) govern your use of robertwrieden.com and swrcf.com (the “Sites”), including our property search, saved searches, mortgage calculator, and related tools. The Sites are operated by Robert Wrieden, a licensed Florida real estate sales associate (“we,” “us,” or “our”), working with Summer Wind Realty Central Florida Inc., a licensed Florida real estate brokerage.

By accessing or using the Sites you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Sites.

Information Only — Not Professional Advice

Content on the Sites, including community guides, market commentary, cost estimates, and blog posts, is provided for general information only. It is not legal, tax, financial, lending, insurance, or investment advice. Real estate decisions can have significant financial consequences, so please consult a licensed attorney, tax professional, lender, or other qualified advisor before relying on any information here.

Using the Sites does not create a brokerage relationship between you and us. A brokerage relationship is created only as described in the written disclosures and agreements required under Florida law.

Listing Information and MLS Data

Property listing information displayed on the Sites is provided through an Internet Data Exchange (IDX) feed from Stellar MLS and its participants. Listing information is deemed reliable but is not guaranteed accurate, and it may change or be withdrawn without notice. Square footage, lot size, school assignments, HOA and CDD fees, and other details should be independently verified.

Listing data is provided exclusively for your personal, non-commercial use. You may use it only to identify properties you may be interested in purchasing, and you may not copy, republish, redistribute, or use it for any other purpose. Listings are presented with the brokerage that holds the listing, as required by the MLS, and the data is refreshed periodically, so it may not reflect the most recent changes.

Estimates and Calculators

Our mortgage calculator and cost estimates are illustrations only. They use assumed interest rates, property tax, and insurance figures that may not match your situation, and they are not a loan offer, pre-approval, quote, or commitment to lend. Interest rates and costs change frequently. We are not a lender or mortgage broker. Please contact a licensed lender for actual terms.

Descriptions of communities, HOA and CDD fees, prices, and amenities reflect the information available to us on the date shown and can change. Always confirm current figures with the community, the association, or the builder before making a decision.

Registration and Your Account

Some features, such as viewing additional listings or saving searches and favorites, may require you to register. You agree to provide accurate information and to keep any login details confidential. You are responsible for activity under your registration. If you believe your account has been used without your permission, please contact us right away.

Calls, Texts, and Emails

If you submit a form, register, or contact us, you agree that we may respond by phone, text message, or email using the details you provided, including in response to saved-search activity. Message frequency varies. Message and data rates may apply. You can opt out of texts at any time by replying STOP, and of emails by using the unsubscribe link in any message. Consent to receive calls or texts is not a condition of buying, selling, or using our services. See our Privacy Policy for how we handle your information.

Acceptable Use

You agree not to:

• Use the Sites for any unlawful purpose, or in a way that is discriminatory, harassing, or abusive.
• Use automated tools, such as scrapers, bots, or spiders, to collect listing data or other content from the Sites.
• Copy, resell, or commercially exploit listing data or other Site content.
• Attempt to interfere with, disable, or gain unauthorized access to the Sites, our systems, or other users’ accounts.
• Submit false or misleading information, or impersonate another person.

Intellectual Property

The text, graphics, logos, photographs, layout, and other original content on the Sites are owned by us or our licensors and are protected by copyright and other laws. Listing photographs and data belong to the MLS, listing brokers, or their licensors. You may view and print Site content for your own personal, non-commercial use. Any other use requires our written permission.

Third-Party Links and Services

The Sites link to and rely on third-party services, including MLS and IDX providers, mapping, analytics, advertising, and lender or community websites. We do not control those services and are not responsible for their content, accuracy, availability, or privacy practices. A link does not mean we endorse the other site.

Disclaimer of Warranties

The Sites and their content are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee that the Sites will be uninterrupted, error-free, or free of harmful components, or that the information on them is complete, current, or accurate.

Limitation of Liability

To the fullest extent permitted by law, we, Summer Wind Realty Central Florida Inc., and our respective owners, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or inability to use, the Sites or reliance on their content. Nothing in these Terms limits any right or duty that cannot be limited under Florida or federal law, or any duty we owe you as a licensed real estate professional once a brokerage relationship exists.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Sites will be brought in the state or federal courts located in Volusia County, Florida, and you consent to their jurisdiction.

Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date above shows when they last changed. Your continued use of the Sites after an update means you accept the revised Terms.

These Terms of Use are effective as of the date listed above and apply to all users of our Sites and services.
